Terms & Condition

This Agreement explains how You purchase tours and travel services and specifically limits the liability of Capital Gate Tourism and Adventure.

You must read this Agreement before using the Site and booking a Tour. Use of the Site constitutes an agreement to all terms and conditions in this Agreement and you warrant that you understand, agree to and accept all terms and conditions contained here.

Pricing & Mode of Payment

Once Capital Gate Tourism and Adventure accepted your request for service and payment has been processed, there is a binding agreement between you and the company.

We accept almost all major credit cards, such as Visa, MasterCard, American Express, Discover, and Diners. Full payment must be done by credit card, and guests are entailed to provide their credit card number to complete the transaction. This, in turn, will be showed as a charge on your statement.

Our policy assures you of an economic pricing, along with the convenience of making reservation online. Price quotes are subject for change at any time due to exchange fluctuation, fuel cost, taxes, government regulations and other factors that are given by suppliers and others that are beyond the company’s control.

 

Confirmation

Reservation will only be accepted by Capital Gate Tourism and Adventure staffs only. Prior booking is required as it is subject for availability (at least 24 hours). Once booking is confirmed by the company in writing, SMS, Watsapp or email, all the terms and condition will apply.

By confirmation of the booking, operator confirms and acknowledges that all terms and condition of the company have been provided and explained to the guest on whose behalf the clients make the booking.

 

Cancellation, No show and Refund Policy

Any cancellation by You must be made by telephone or email and acknowledged by CapitalGateTourismandAdventure. The date on which the request to cancel is received by CapitalGateTourismandAdventure will determine the refund due as follows:

  • For trips cancelled / amended 48 hrs. prior to the tour date, no cancellation charges will be applicable.
  • If trip cancelled / amended within 24 to 48 hrs. prior to the tour date, 50% cancellation charges will be applicable
  • If trip cancelled / amended 24 hrs. prior to the tour date, 100% cancellation charges will be applicable.
  • If the payment is done by credit card online then there will be a charge of 5% (online service charge) for refunding the money back.

All cancellation should be made in writing and will be only deemed effective upon acknowledge of receipt of the company.

 

In some cases, the CapitalGateTourismandAdventure may cancel a tour due to weather or other circumstance. In the event that the Tour Guide cancels the tour, or does not deliver it as promised, You may choose between a rescheduling of the tour OR a full refund of all monies paid or a credit towards an alternative tour. If you choose to accept a credit, the difference in the cost of the alternative tour will be refunded by CapitalGateTourismandAdventure or paid by You, as applicable.

CapitalGateTourismandAdventure is not responsible for any incidental expenses You may have incurred in reliance on the tour or travel services booked on the Site, including, without limitation, expenses arising from the purchase of visas, vaccinations, non-refundable flights, or of any loss of enjoyment.

ACCEPTANCE OF RISK AND WAIVER OF LIABILITY

You acknowledge that all travel involves an element of risk and that some tours offered on the Site may be adventurous in nature and may involve a significant amount of personal risk. You hereby assume all such risk and You, your estate, your family, heirs and assigns hereby release CapitalGateTourismandAdventure from all claims and causes of action whatsoever arising from any injury, death or other damages, both pecuniary and non-pecuniary, to You that may occur as a result of your participation in the tours offered on the Site or as a result of the negligence of any party, including the Tour Guide or any employee, officer, agent whether such negligence is passive or active.

You are strongly encouraged to obtain suitable medical insurance prior to booking a tour.

We urge you to exercise caution if you purchase any goods during your tour. CapitalGateTourismandAdventure make any claims about the quality, source or other provenance of any goods which may be available for purchase.

Health

The Company shall ensure that the guest acknowledges and is aware of the proposed itinerary and confirms that he/she is medically fit, in good physical and mental health and that there is nothing which renders him/her unfit to undertake the tour.

  • Guest with pre-existing medical condition or pregnant must declare the true nature of such condition to the company before the commencement of the tour.
  • Guest who requires prescription medication, are advised to carry it inside their personal bag as medication is not available in remote areas.
  • Company will not be liable to any medical condition that may arise during the tour.

 

Insurance

  • The company will provide insurance for any accident occurrence for the City tours and safaris provided that guest is inside the vehicle as company vehicle have a third party liabilities. The vehicle insurance does not cover any accident that occurred outside the vehicle such as sand boarding, quad bikes and camel rides.
  • In the event that the guest falls ill or should be injured during the tour, the Client shall be responsible for all hospital, doctor, medical and repatriation costs and the Company shall not be liable for any refund of the tour fee for any reason whatsoever.

 

Prohibited Use

The Site may not be used to recruit, solicit, or contact Tour Guides for employment or contracting for a business not affiliated with CapitalGateTourismandAdventure unless you first obtain express written permission from CapitalGateTourismandAdventure.

Information Provided by You

You are responsible for providing accurate, timely and complete information in connection with Your registration for and use of the Site. CapitalGateTourismandAdventure is not responsible for any claims relating to any inaccurate, untimely or incomplete information provided to us by You.

CapitalGateTourismandAdventure will only use your information in accordance with our Privacy Policy

 

Travel Documents

It is the responsibility of every guest to ensure that he or she carries documents relevant for a particular tour, including passport or a valid ID card. This is especially important for guests coming from a different country. No refund can be done in the event of loss or lack of these relevant documents. Similarly, passengers – irrespective of their nationality – are advised to check with their respective country´s consulate here to gain information on entry requisites, before they plan to visit here. Equally vital is to inquire with your consulate regarding the current visa and health requirements, as they are subject to change without prior notice.

Term of Agreement

This Agreement will become effective immediately upon your use of the Site and shall remain effective unless terminated by either party as provided here. Either party may terminate this Agreement by providing the other with written or email notice of such termination which shall be effective immediately upon delivery of such notice to the other party. Furthermore, CapitalGateTourismandAdventure may terminate this Agreement immediately for any breach by You of this Agreement or any applicable policy of CapitalGateTourismandAdventure as posted on the Site from time to time.

Should You violate the terms of this Agreement, CapitalGateTourismandAdventure reserves the right, without prejudice to any other rights or remedies available to CapitalGateTourismandAdventure, to terminate your use of this Site immediately at its sole discretion.

Intellectual Property Rights

All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) that You see or read on the Site is owned by CapitalGateTourismandAdventure, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. You may not copy, download, use redesign, reconfigure, or retransmit anything from the Site without the prior written permission of CapitalGateTourismandAdventure.

General Terms and Condition

Visitors are requested to not wear revealing and skimpy cloth. We would advise guest to wear comfortable and loose clothes. Smart casual wear is suggested for the guest to wear.

  • Carrying alcohol during the tour is strictly prohibited as part of the government rules. Guest will be provided drinks (softdrinks, water, coffee and tea) inside the camp as it is part of the package.
  • Smoking is also strictly prohibited inside the vehicle.
  •  Quad bik, Dune Buggy & Jet ski: Before starting buggy guest should sign the disclaimer form, the form will be provided by us. CapitalGateTourismandAdventure will not be responsible for any Quad bike Accident and nor will be covered by Insurance.
  • Photography of military and police installations and other government agencies is strictly prohibited. Before photographing any local residents, kindly ask their permission. Photographing ladies is not permitted.
  • Schedules are likely to change during the holy month of Ramadan. Alcohol and Belly Dance will not be available during Ramadan. Please contact our representative for updates.
  • Any increase in fuel prices, government taxes will reflect immediately on this proposal.
  • All tours and excursions pickup location should be Hotels with in Abu Dhabi city.
